- ಹಿಟ್ ಅಂಡ್ ರನ್ ಅಪಘಾತ ಯೋಜನೆ, 2022 ರ ಸಂತ್ರಸ್ತರಿಗೆ ಪರಿಹಾರವು ರಸ್ತೆ ಸಾರಿಗೆ ಮತ್ತು ಹೆದ್ದಾರಿಗಳ ಸಚಿವಾಲಯದ ವತಿಯಿಂದ ರೂಪಿಸಲಾದ ಯೋಜನೆಯಾಗಿದೆ.
- ಈ ಯೋಜನೆಯನ್ನುಏಪ್ರಿಲ್ 1, 2022 ರಂದು ಜಾರಿಗೊಳಿಸಲಾಗಿತ್ತು.
- ಈ ಯೋಜನೆ ಜಾರಿಯಾಗುವ ಮೊದಲು ಕಂಫರ್ಟ್ ಸ್ಕೀಮ್ 1989, ಹಿಟ್ ಅಂಡ್ ರನ್ ಮೋಟಾರು ಅಪಘಾತದ ಸಂತ್ರಸ್ತರಿಗೆ ಪರಿಹಾರವನ್ನು ಪಾವತಿಸಲು ಭಾರತ ಸರ್ಕಾರವು ಹಿಂದಿನ ಯೋಜನೆಯಾಗಿದೆ.
- ಕಂಫರ್ಟ್ ಸ್ಕೀಮ್ 1989 ಯೋಜನೆಯ ಅಡಿಯಲ್ಲಿ, ಪರಿಹಾರದ ಮೊತ್ತ ರೂ. 50,000/- ಸಂತ್ರಸ್ತರ ಮರಣ ಮತ್ತು ರೂ. 12,500/- ಹಿಟ್ ಅಂಡ್ ರನ್ ಕೇಸ್‌ಗಳಲ್ಲಿ ಗಂಭೀರ ಗಾಯಗಳಾಗಿದ್ದರೆ.
- ಆದರೆ ಹಿಟ್ ಅಂಡ್ ರನ್ ಯೋಜನೆ, 2022 ರ ಸಂತ್ರಸ್ತರಿಗೆ ಪರಿಹಾರದ ಅಡಿಯಲ್ಲಿ, ರಸ್ತೆ ಸಾರಿಗೆ ಮತ್ತು ಹೆದ್ದಾರಿ ಸಚಿವಾಲಯವು ಸಾವಿನ ಹಿಂದಿನ ಪರಿಹಾರವನ್ನು ರೂ. 2,00,000/- ಮತ್ತು ರೂ. 50,000/- ಗಂಭೀರ ಗಾಯಕ್ಕಾಗಿ.
ಯೋಜನೆಯ ವೈಶಿಷ್ಟತೆಗಳು
- ಪರಿಹಾರ ಮೊತ್ತವನ್ನು ವಾಹನ ಕಾಯ್ದೆಯ ಸೆಕ್ಷನ್ 164B ಅಡಿಯಲ್ಲಿ ರಚಿಸಲಾದ ಮೋಟಾರು ವಾಹನ ಅಪಘಾತ ನಿಧಿಯಿಂದ ನಿರ್ವಹಿಸಲಾಗುತ್ತದೆ.
- ಮೋಟಾರು ವಾಹನ ಅಪಘಾತ ನಿಧಿ ಈ ಕೆಳಗಿನ ವಾಹನಗಳನ್ನು ಒಳಗೊಂಡಿದೆ :-
- ವಿಮೆ ಮಾಡಿದ ವಾಹನದ ಖಾತೆ.
- ವಿಮೆ ಮಾಡದ ವಾಹನಗಳಿಗೆ ಖಾತೆ.
- ಈ ಯೋಜನೆಯ ಮೇಲ್ವಿಚಾರಣೆ, ಪರಿಶೀಲನೆ ಮತ್ತು ನಿರ್ವಹಣೆಗೆ ಕೇಂದ್ರ ಮಟ್ಟದಲ್ಲಿ ಸ್ಥಾಯಿ ಸಮಿತಿ ಇರುತ್ತದೆ.
- ಈ ಯೋಜನೆಯಡಿ ಮೇಲ್ವಿಚಾರಣೆ ಮಾಡಲು, ಸರಿಪಡಿಸುವ ಕ್ರಮಗಳನ್ನು ತೆಗೆದುಕೊಳ್ಳಲು, ಯೋಜನೆಯ ಪ್ರಗತಿಯನ್ನು ಮೌಲ್ಯಮಾಪನ ಮಾಡಲು ಈ ಯೋಜನೆಯಡಿ ಜಿಲ್ಲಾ ಮಟ್ಟದ ಸಮಿತಿಯನ್ನು ರಚಿಸಲಾಗಿದೆ.
- ಈ ಯೋಜನೆಯಡಿ ಪರಿಹಾರ ಮಂಜೂರಾತಿ ಆದೇಶದ 15 ದಿನದೊಳಗೆ ಪರಿಹಾರವನ್ನು ಪಾವತಿಸುವುದು ಕಡ್ಡಾಯವಾಗಿದೆ.
ಕ್ಲೇಮ್ ಪಡೆಯುವ ವಿಧಾನ
- ಹಿಟ್ ಅಂಡ್ ರನ್ ಯೋಜನೆಯಡಿ ಪರಿಹಾರ ಪಡೆಯಲು ಅರ್ಜಿದಾರರು ಫಾರ್ಮ್ I ಸರಿಯಾಗಿ ಭರ್ತಿ ಮಾಡಿದ ಅರ್ಜಿಯನ್ನು ಸಲ್ಲಿಸಬೇಕು.
- ಈ ಯೋಜನೆ ಅಡಿ ನಗದು ರಹಿತ ಚಿಕಿತ್ಸಾ ಪಾವತಿಗಾಗಿ ಚಿಕಿತ್ಸೆಯನ್ನು ಒದಗಿಸುವ ಆಸ್ಪತ್ರೆಯು ಸಂಗ್ರಹಿಸಿದ ಕ್ಲೈಮ್‌ನ ಪ್ರತಿಯೊಂದಿಗೆ ನಮೂನೆಯನ್ನು ಲಗತ್ತಿಸಬೇಕು.
- ಅಂಡರ್ಟೇಕಿಂಗ್ ಅನ್ನು ಉಲ್ಲೇಖಿಸಲಾಗಿದೆ ಫಾರ್ಮ್ IV ಅರ್ಜಿ ನಮೂನೆಯೊಂದಿಗೆ ಸರಿಯಾಗಿ ಲಗತ್ತಿಸಲಾಗಿದೆ.
- ನಮೂದಿಸಿರುವ ಯಾವುದೇ ಸಂಬಂಧಿತ ದಾಖಲೆ ಫಾರ್ಮ್ I ಅರ್ಜಿ ನಮೂನೆಯೊಂದಿಗೆ ಲಗತ್ತಿಸಬೇಕು.
- ಅಗತ್ಯವಿರುವ ಎಲ್ಲಾ ನಮೂನೆಗಳನ್ನು ಸರಿಯಾಗಿ ಭರ್ತಿ ಮಾಡಿ ಅಪಘಾತ ಸಂಭವಿಸಿದ ಉಪವಿಭಾಗ ಅಥವಾ ತಾಲೂಕಿನ ಕ್ಲೈಮ್ ವಿಚಾರಣಾ ಅಧಿಕಾರಿಗೆ ಸಲ್ಲಿಸಬೇಕು.
- ಹಿಟ್ ಅಂಡ್ ರನ್ ಯೋಜನೆ ಅಡಿ ಕ್ಲೈಮ್ ವಿಚಾರಣೆ ಅಧಿಕಾರಿಯು ದಾಖಲೆಗಳನ್ನು ಪರಿಶೀಲಿಸುತ್ತಾರೆ ಮತ್ತು ಪರಿಹಾರದ ಹಕ್ಕು ನಿಜವೇ ಅಥವಾ ಇಲ್ಲವೇ ಎಂಬುದನ್ನು ನಿರ್ಧರಿಸುತ್ತಾರೆ.
- ಕ್ಲೈಮ್ ವಿಚಾರಣೆ ಅಧಿಕಾರಿ ತನ್ನ ವರದಿಯನ್ನು ಕ್ಲೈಮ್ಸ್ ಸೆಟ್ಲ್‌ಮೆಂಟ್ ಕಮಿಷನರ್‌ಗೆ ಸಾಧ್ಯವಾದಷ್ಟು ಬೇಗ ಸಲ್ಲಿಸಿ.
- ಈ ಯೋಜನೆ ಅಡಿ ಸಲ್ಲಿಸಲಾದ ಕ್ಲೇಮ್ ಹಕ್ಕು ಸ್ವರೂಪದಲ್ಲಿ ಸರಿಯಾಗಿದೆ ಎಂದು ಕಂಡುಬಂದರೆ, ಮಂಜೂರಾತಿ ಆದೇಶದ 15 ದಿನಗಳಲ್ಲಿ, ಪರಿಹಾರದ ಮೊತ್ತವನ್ನು ಫಲಾನುಭವಿ ಖಾತೆಗೆ ವರ್ಗಾಯಿಸಲಾಗುತ್ತದೆ.
ಕ್ಲೈಮ್ ಅಧಿಕಾರಿ ಕಾರ್ಯವಿಧಾನ
- ಅರ್ಜಿದಾರರಿಂದ ಹಕ್ಕು ಅರ್ಜಿಯನ್ನು ಸ್ವೀಕರಿಸಿ.
- ಕ್ಲೈಮ್ ವಿಚಾರಣಾ ಅಧಿಕಾರಿ ಮೊದಲು ಅಪಘಾತ ವರದಿಯನ್ನು ಪಡೆದುಕೊಳ್ಳಿ ಮತ್ತು ಪೋಸ್ಟ್‌ಮಾರ್ಟಮ್ ವರದಿಯನ್ನು (ಸಾವಿನ ಸಂದರ್ಭದಲ್ಲಿ) ಸಂಬಂಧಪಟ್ಟ ಅಧಿಕಾರಿಗಳನ್ನು ರಚಿಸುತ್ತಾರೆ.
- 1 ಕ್ಕಿಂತ ಹೆಚ್ಚು ಹಕ್ಕುದಾರರಿದ್ದರೆ, ಹಕ್ಕು ವಿಚಾರಣಾ ಅಧಿಕಾರಿಯು ಸರಿಯಾದ ಹಕ್ಕುದಾರನನ್ನು ನಿರ್ಧರಿಸುತ್ತಾರೆ.
- ಪರಿಹಾರದ ಕ್ಲೈಮ್ ಅರ್ಜಿಯನ್ನು ಸ್ವೀಕರಿಸಿದ ದಿನಾಂಕದಿಂದ, ಕ್ಲೈಮ್ ವಿಚಾರಣಾ ಅಧಿಕಾರಿಯು ತನ್ನ ವರದಿಯನ್ನು ಒಂದು ತಿಂಗಳ ಅವಧಿಯೊಳಗೆ ಕ್ಲೈಮ್ ಇತ್ಯರ್ಥ ಆಯುಕ್ತರಿಗೆ ಸಲ್ಲಿಸಬೇಕು.
- ಕ್ಲೇಮ್ ವಿಚಾರಣೆಯ ಆಯುಕ್ತರು ಹೆಚ್ಚುವರಿ ವಿಚಾರಣೆಗಾಗಿ ಕ್ಲೈಮ್ ವಿಚಾರಣೆ ಅಧಿಕಾರಿಯ ವರದಿಯನ್ನು ಹಿಂತಿರುಗಿಸಿದರೆ, ಕ್ಲೈಮ್ ವಿಚಾರಣಾ ಅಧಿಕಾರಿಯು ಕ್ಲೈಮ್ ಅನ್ನು ಮರು-ವಿಚಾರಣೆ ಮಾಡಬೇಕು ಮತ್ತು ಅದರ ವರದಿಯನ್ನು 15 ದಿನಗಳ ಅವಧಿಯೊಳಗೆ ಕ್ಲೈಮ್ ವಿಚಾರಣೆ ಕಮಿಷನರ್‌ಗೆ ಪುನಃ ಸಲ್ಲಿಸಬೇಕು.
ಹಾಕೋ ಮಂಜೂರಾತಿ ಸೂಚನೆಗಳು
- ಕ್ಲೈಮ್ ವಿಚಾರಣೆ ಅಧಿಕಾರಿಯಿಂದ ವರದಿಯನ್ನು ಸ್ವೀಕರಿಸಿದ ನಂತರ, ಕ್ಲೈಮ್ ಸೆಟಲ್ಮೆಂಟ್ ಕಮಿಷನರ್ ಅವರು ಕ್ಲೈಮ್ ಅನ್ನು ಮಂಜೂರು ಮಾಡುವ ಹಕ್ಕನ್ನು ಹೊಂದಿರುತ್ತಾರೆ.
- ಈ ಯೋಜನೆ ಅಡಿ ಕ್ಲೈಮ್‌ಗಳ ಆಯುಕ್ತರು ಕ್ಲೈಮ್ ಅನ್ನು ಆದಷ್ಟು ಬೇಗ ಮಂಜೂರು ಮಾಡುವುದು ಕಡ್ಡಾಯವಾಗಿದೆ ಆದರೆ ವರದಿಯನ್ನು ಸ್ವೀಕರಿಸಿದ ದಿನಾಂಕದಿಂದ 15 ದಿನಗಳನ್ನು ಮೀರಬಾರದು.
- ಈ ಯೋಜನೆ ಅಡಿ ಬಲಿಪಶುವಿನ ಚಿಕಿತ್ಸೆಗಾಗಿ ಆಸ್ಪತ್ರೆಗಳು ಸಂಗ್ರಹಿಸಿದ ಕ್ಲೈಮ್‌ನ ಮೊತ್ತವನ್ನು ಕಡಿತಗೊಳಿಸುವ ಹಕ್ಕು ಕ್ಲೇಮ್‌ಗಳ ಇತ್ಯರ್ಥ ಆಯುಕ್ತರಿಗೆ ಇದೆ.
- ಚಿಕಿತ್ಸೆಗಾಗಿ ಆಸ್ಪತ್ರೆಯು ಕ್ಲೈಮ್ ಮಾಡಿದ ಮೊತ್ತವು ಯೋಜನೆಯಲ್ಲಿ ನಿಗದಿತ ಪರಿಹಾರದ ಮೊತ್ತಕ್ಕಿಂತ ಹೆಚ್ಚಿದ್ದರೆ, ಆ ಸಂದರ್ಭದಲ್ಲಿ ಯಾವುದೇ ಮೊತ್ತವನ್ನು ಹಕ್ಕುದಾರರಿಗೆ ಅಥವಾ ಮೃತರ ಕಾನೂನು ಪ್ರತಿನಿಧಿಗೆ ಪಾವತಿಸಲಾಗುವುದಿಲ್ಲ.
- ಈ ಯೋಜನೆ ಅಡಿ ಕ್ಲೈಮ್‌ಗಳ ಇತ್ಯರ್ಥ ಆಯುಕ್ತರಿಗೆ ವರದಿಯ ಮೇಲೆ ಸಂದೇಹವಿದ್ದರೆ ಅವರು ಮರು ವಿಚಾರಣೆಗಾಗಿ ಕ್ಲೈಮ್ ವಿಚಾರಣೆ ಅಧಿಕಾರಿಗೆ ವರದಿಯನ್ನು ಹಿಂತಿರುಗಿಸುತ್ತಾರೆ.
- ಕ್ಲೈಮ್ ನ್ಯಾಯಯುತವೆಂದು ಕಂಡುಬಂದರೆ, ಕ್ಲೈಮ್ ಸೆಟಲ್ಮೆಂಟ್ ಕಮಿಷನರ್ ಪರಿಹಾರದ ಮೊತ್ತವನ್ನು ಮಂಜೂರು ಮಾಡುತ್ತಾರೆ ಮತ್ತು ಅಂತಿಮ ವಿತರಣೆಗಾಗಿ ಅವರ ಮಂಜೂರಾತಿ ಆದೇಶವನ್ನು ಜನರಲ್ ಇನ್ಶುರೆನ್ಸ್ ಕೌನ್ಸಿಲ್ಗೆ ಕಳುಹಿಸುತ್ತಾರೆ.
ಪರಿಹಾರ ಪಾವತಿಯ ಸೂಚನೆಗಳು
- ಸಂತ್ರಸ್ತೆಯ ಮರಣದ ಸಂದರ್ಭದಲ್ಲಿ ಪರಿಹಾರದ ಮೊತ್ತ ಅಂದರೆ ರೂ. 2,00,000/- ಮೃತರ ಕಾನೂನು ಪ್ರತಿನಿಧಿಗೆ ಪಾವತಿಸಲಾಗುವುದು.
- ಗಂಭೀರ ಗಾಯದ ಸಂದರ್ಭದಲ್ಲಿ, ಪರಿಹಾರದ ಮೊತ್ತವನ್ನು ಅಂದರೆ ರೂ. 50,000/- ಗಾಯಗೊಂಡ ವ್ಯಕ್ತಿಗೆ ನೇರವಾಗಿ ಪಾವತಿಸಲಾಗುವುದು.
- ಜನರಲ್ ಇನ್ಶೂರೆನ್ಸ್ ನೇರವಾಗಿ ಹಕ್ಕುದಾರ ಅಥವಾ ಮೃತರ ಕಾನೂನು ಪ್ರತಿನಿಧಿ ಒದಗಿಸಿದ ಬ್ಯಾಂಕ್ ಖಾತೆಗೆ ಆರ್ಥಿಕ ನೆರವನ್ನು ಜಮಾಹಿಸಲಾಗುವುದು.
- ಆದೇಶದ ಸ್ವೀಕೃತಿಯ ದಿನಾಂಕದಿಂದ 15 ದಿನಗಳ ಅವಧಿಯೊಳಗೆ ಪಾವತಿ ಮಾಡುವುದು ಕಡ್ಡಾಯವಾಗಿದೆ.
- ಈ ಯೋಜನೆ ಅಡಿ ಕ್ಲೇಮ್ ಒದಗಿಸುವ ಸಂದರ್ಭದಲ್ಲಿ ಯಾವುದೇ ಕಾರಣದಿಂದ ಪಾವತಿ ವಿಳಂಬವಾದರೆ, ಕ್ಲೈಮ್ಸ್ ಇತ್ಯರ್ಥ ಆಯುಕ್ತರು ಲಿಖಿತವಾಗಿ ಕಾರಣವನ್ನು ದಾಖಲಿಸಬೇಕು.

- ಫಾರ್ಮ್ I (ಹಿಟ್ ಮತ್ತು ರನ್ ಪರಿಹಾರ ನಿಧಿಯಿಂದ ಪರಿಹಾರಕ್ಕಾಗಿ ಅರ್ಜಿ ನಮೂನೆ).
- ಫಾರ್ಮ್ II (ಕ್ಲೈಮ್ ವಿಚಾರಣೆಯ ವರದಿಯನ್ನು ಕ್ಲೈಮ್ ವಿಚಾರಣೆ ಅಧಿಕಾರಿ ಸಲ್ಲಿಸಬೇಕು.
- ನಮೂನೆ III (ಹಕ್ಕುಗಳ ಪರಿಹಾರ ಆಯುಕ್ತರ ಆದೇಶ).
- ಫಾರ್ಮ್ IV (ಹಕ್ಕು ಮರುಪಾವತಿಗಾಗಿ ಕೈಗೊಳ್ಳುವುದು).
